Clobber Swap Terms & Conditions
Welcome to Clobber Swap. By subscribing to, accessing, or using ClobberSwap.co.uk, the Clobber Swap Facebook community, or any associated services, you agree to be bound by these Terms & Conditions.
1. Membership & Subscription
1.1 Monthly Subscription
Membership subscriptions automatically renew each month unless cancelled by the member.
1.2 Right to Cancel Within 14 Days
You have the right to cancel your subscription within 14 days of purchase without giving a reason.
However, if you have actively used the service, including but not limited to:
- Listing items for sale or swap
- Contacting other members regarding transactions
- Completing a sale or swap
any refund request will be considered at the discretion of Clobber Swap Ltd.
1.3 Cancelling Your Subscription
Members may cancel their subscription through their account dashboard area on ClobberSwap.co.uk.
Memberships are subject to a minimum initial term of three (3) months.
Active memberships may only be cancelled once the first three months of membership have been completed.
Upon cancellation:
- Access to member-only areas may be removed immediately.
- No refunds will be provided for unused membership periods after the initial 14-day cancellation period.
1.4 Re-Subscription
Former members may re-subscribe at any time using their existing account details unless their membership has previously been terminated.
2. Listings & Sales
2.1 Listing Items
Items may be advertised in both:
- The Clobber Swap Facebook community; and
- ClobberSwap.co.uk.
Members are responsible for ensuring their listings are accurate, honest, and up to date.
2.2 Website Sales Take Priority
If an item sells through ClobberSwap.co.uk before a Facebook transaction has been completed, the website sale will take precedence.
2.3 Updating Listings
When an item has sold, sellers must update any corresponding Facebook listing as “Sold” as soon as reasonably possible.
2.4 Website Checkout
Items purchased through ClobberSwap.co.uk are secured at checkout once payment has been successfully completed.
A seller must honour the completed website transaction and must not sell the item elsewhere after payment has been received.
Clobber Swap’s payment processing, order records, transaction support and seller-payout controls apply only to orders completed and paid for through Clobber Swap checkout.
2.5 Secure Checkout & Transaction Fee
A mandatory Secure Checkout & Transaction Fee applies to each order placed through the Clobber Swap Ltd website.
The fee is calculated as 6% of the item price plus £0.70 and is shown to the buyer before payment is made. The fee is charged in addition to the item price and any applicable postage or delivery charge.
It is a platform service fee and is not insurance, shipping insurance, a delivery guarantee, or a promise that Clobber Swap Ltd will refund postage, replace an item, or compensate a buyer for every issue that may arise.
2.6 Seller Responsibility
Sellers are responsible for:
- Providing accurate descriptions.
- Disclosing defects, damage, or alterations.
- Supplying accurate photographs.
- Dispatching items within a reasonable timeframe of 3-5 days by 2nd class post.
2.7 Seller Entitlement
Eligible paid Clobber Sisters sellers are charged 0% selling commission on the listed item price. This means that, subject to the order completing and to any refund, reversal, dispute, chargeback, tax or legal obligation, the seller is entitled to receive 100% of the listed item price.
Postage, buyer-facing Secure Checkout & Transaction Fees, payment-processing arrangements and membership fees are treated separately from the listed item price.
Seller proceeds become eligible for automatic payout only after delivery is confirmed without an issue being raised through the Clobber Swap Ltd order process.
Clobber Swap Ltd may pause the payout of an affected order while it reviews a reported issue, payment reversal, suspected fraud or other reasonable concern.
Payment-provider processing times may apply after payout is initiated.
3. Returns & Refunds
3.1 General Policy
As most items sold through Clobber Swap Ltd are pre-owned goods swapped or sold between members, returns and refunds are not generally accepted.
3.2 Exceptions
A return or refund from the seller and/or swapper may be considered where it is clear that:
- The item is faulty; or
- The item received is clearly different from the description or images provided by the seller.
3.3 Change of Mind
Clobber Swap Ltd members do not accept returns or refunds for:
- Change of mind.
- Item that doesn’t fit.
- Personal preference.
- Delays caused by postal or courier services.
3.4 Disputes
Where a dispute arises between buyer and seller, both parties should attempt to resolve the matter directly.
Clobber Swap Ltd may request reasonable evidence, including photographs, tracking information, listing details and communications.
Clobber Swap Ltd reserves the right to review evidence and take action against members who repeatedly breach these Terms.
4. Swaps
4.1 Member-to-Member Swaps
Clobber Swap Ltd provides a platform to facilitate swaps between members but is not a party to any swap agreement.
4.2 Completion of a Swap
A swap is deemed complete only when both parties have received the item agreed as part of the swap.
4.3 Responsibility for Swaps
The successful completion of a swap is the sole responsibility of the members involved.
Members should ensure:
- Accurate item descriptions are provided.
- Suitable postal services are used.
- Tracking and proof of postage are retained where possible.
4.4 Liability
Clobber Swap Ltd is not responsible for:
- Incomplete swaps.
- Lost parcels.
- Damaged parcels.
- Members failing to send agreed items.
- Disputes arising from member-to-member swap or sale arrangements.
5. Member Conduct
Members must:
- Treat other members respectfully.
- Provide accurate information.
- Complete transactions promptly.
- Honour agreed sales and swaps.
- Comply with all applicable laws.
Clobber Swap reserves the right to remove listings, suspend memberships, or permanently ban members who breach these Terms.
Members must not use Clobber Swap listings, profiles, group posts or messages primarily to redirect a buyer or seller away from the Clobber Swap checkout in order to avoid marketplace fees or transaction controls.
6. Termination by Clobber Swap Ltd
Clobber Swap Ltd may remove content, restrict listings, suspend marketplace access or take other reasonable account action where it reasonably believes a member is repeatedly attempting to circumvent the website checkout, payment or safety processes.
Clobber Swap Ltd may terminate a membership immediately and without refund where a member:
- Acts fraudulently.
- Repeatedly fails to complete transactions.
- Misrepresents items.
- Harasses other members.
- Breaches these Terms & Conditions.
Removal from the platform may result in restriction from future membership applications.
7. Limitation of Liability
Clobber Swap Ltd acts solely as a platform connecting buyers, sellers, and swappers.
To the fullest extent permitted by law, Clobber Swap Ltd shall not be liable for:
- The quality, condition, authenticity, or legality of items.
- Losses arising from member transactions.
- Incomplete sales or swaps.
- Postal or courier issues.
- Any indirect or consequential loss arising from use of the platform.
